Item 7.01. Regulation FD Disclosure.

On July 7, 2008, China BAK Battery, Inc. (the “Company”) issued a press release announcing that the 2008 Annual Meeting of Stockholders of the Company will be held on Monday, July 28, 2008 (the “Annual Meeting"), more than 30 days before the one-year anniversary of the 2007 annual meeting of stockholders of the Company, which was held on September 21, 2007. A copy of the press release is furnished as Exhibit 99.1 hereto.
