Potential huge liabilty for AEP. Many property owners have been harmed by the actions of AEP.
From the Unanimous Decision attached ...
DIANA GRIBBON MOTZ, US 4th Circuit Judge wrote:
"Landowners brought this action in state court seeking a declaration of their rights to build a dock on property subject to a flowage easement. After the power company, which owns the easement, removed the case to federal court, the landowners sought to remand the case to state court. The district court denied the motion to remand and then dismissed the landowners’ complaint. Because the district court lacked subject matter jurisdiction, we must vacate and remand."
Over the next few days CURB will furnish more analysis and discuss the impact of this decision upon Smith Mountain Lake landowners, businesses, local organizations, and local governments.
Bottomline: (1) APCO can no longer fabricate federal jurisdiction to drag private property owners to federal court for violation of the Federal Power Act, Shoreline Management Plan or its Federal License; (2) APCO has no federal right to demand that property owners apply for permits; (3) Permits that APCO issued may be invalid, since those permits claimed APCO held federal authority under their license to regulate private property; (4) Virginia state court will eventually determine Pressls' rights under the flowage easement and APCO will be forced to prove how anyone's dock prevents APCO from flooding and operating the dam and associated power station.

Agree, 'nWo,' & that's why AEP is one of the few good yield dividend paying stocks I own and added to, over the last several years. All those MB's are indeed "dead," and not fun to follow. It's why, although I check them now and then, I almost never post on any of them.
The fun (call it human drama, ignorance, silly claims, obvious P&D's, you name it) is in the ever changing sentiment inside the penny MB's. Pennies are not only a good critical thinking exercise, but following them one is never getting bored, nor out of shape. They give an educated mind the motivation to keep up with the many new developments, discover the many frauds associated with most of them, and see some of them grow exponentially. It's why I always have quite a few penny stocks, hand-picked mostly from what I call "good value penny bottoms," which thereafter, in my portfolio, usually become mid- or long-term.

I don't doubt the consumption being that much higher... It should continue to grow as the 30+ states with EPA changes to coal burners will be converting to NG even more...
Trick is the production is still higher than consumption even with the increase.
The panic is over for now and prices are stable (the panic being the super high production, they over sold futures)... again, hurt could come in the form of the Canadian pipeline to America (that would topple supplies and start the worst prices in scores - pre mid-70's). I hope Obama was just jive-talking again to match Mitt and not really meaning to make such a bad move for American producers...
The proof, being we were supposed to have hich prices this December... lol... because of increase demand... (but the supply also increased).
It's a con game, they can swing it for a while one way to save face like they did when NG went to 4.70+/Mcf prior to the big fall... lol... So, in other words, they could swing it to 6/Mcf if Winter would arrive if force as that's what the market was expecting... (actually 8/Mcf by one article http://www.forbes.com/sites/richardfinger/2012/07/22/were-headed-to-8-00-natural-gas/print/ )
Ride the tide, watch for tsunamis http://www.tsunami.noaa.gov/ (oh, silly me... wrong tsunami... http://ir.eia.gov/ngs/ngs.html )
OH MY! Haven't looked in a while and the companies have been chocking dry gas wells and killing drilling of them for over a year now ... and did you look? !!!! Production is way, down compared to last year!!! Yeah Ha! (unless they bring down Candian NG)....
Is that enough insight into your question of what I thought about consumption being up 150% last Sabbath?
