The Harris County ruling defied logic in my opinion and appeared difficult to reconcile with what the Virginia federal court had already determined regarding the limited nature of the receivership and the satisfaction of the original judgment. That said, the appellate courts will ultimately have the final say, and hopefully more sense.

What is becoming clear is that Cyberlux is attacking this from multiple angles. The Virginia appeal challenges the $6 million judgment, while the Texas appeals appear poised to challenge both the scope of the receivership and the massive fee award. If an appellate court eventually determines the receiver's authority was too broad, or that the receivership should have ended once the judgment was satisfied, it could have significant implications for actions taken afterward.

Unfortunately, appellate litigation moves at a glacial pace, so this is likely measured in many months rather than weeks.

It is good to see that they intend on appealing the scope of the receivership as well as the fees associated with it. Honestly, the scope is the biggest issue. While Johnnyt5 is correct that there has not been a formal finding of a new receivership as of yet, that does not mean that we are suffering under the presumption of one. Judge Gomez included the following paragraph in his order terminating the original receivership:

" The Court takes judicial notice that the termination of this receivership will
animate the next serial receivership. Cyberlux will remain under
receivership without interruption pending further orders in that case;"

While that is not an order appointing a receiver, it shows you the Judge's intent. Also keep in mind that the newest enforcement case (the 6 million judgment plus costs) has been transferred to Judge Gomez' division, so he now presides over that case. Cyberlux has yet to file any motions in that case to try to get a stay of the enforcement case despite appealing the judgement in Virginia. As I have said before, Texas is one of a very few states that allows enforcement of foreign judgements while they are still under appeal in the original jurisdictions (it is really rare and odd). That being said, Texas does allow for that case to be STAYED (no action taken upon it) until the appellate process is competed in the original jurisdiction. So there is an avenue to (at lease temporarily) avoid a formal appointment of receivership. As of yesterday (last I checked the case) Cyberlux has NOT filed any motions requesting to STAY the proceedings in the Texas case. I am not sure why they have not, but they have not. In my mind, if they can get that case stayed, they can request an amended final order in the original receivership case that removes the damaging paragraph. If that were to happen, they could demonstrate to our government that the receivership is over and they are not currently under the threat of another one which should allow them to get government contracts. This strategy seems logical to me but as of yet they have not pursued it. So we all wait and see.

Assuming no reverse stock split this could easily hit.05 cents if legal issue are resolved.

The case I am speaking of was not non suited.   It was negotiated by the receiver over Cyberlux’s objection and without their input.   I have read the trial judges order on that judgement.   Cyberlux is currently appealing that case in Virginia but Texas is one of the very few States that allow for foreign judgement enforcement while the case is still pending appeal.    The judgement is very real and could cause real issues for us.

I don’t think that there has been a final determination in the interpleader case.   That being said, there are claims for far more than the amount held by the court.    I don’t know anything about most of those claims but if they are legit, there may not be any money to go back to Cyberlux.

The Texas Judge seems to be very kind to the receiver. He let this thing drag out for a year, after the money was tendered, so the receiver could do all kinds of thing to justify his large fee and then he finds everything the receiver did was on the up and up. Only the Federal Judge on the interpleader case seems to see through this receiver, but the other Judges just let him do whatever. The underlying 6 million judgement against Atlantic Wave out of Virginia was NEGOTIATED by the receiver against the wishes of Cyberlux and the Judge in the case wrote an opinion saying it was all fine. That case is now on appeal. Most States do not let foreign judgements be executed UNTIL the appellate process is over, but Texas does. Cyberlux can ask Judge Gomez to stay the newest enforcement action (and soon to be receivership) until the Virginia appellate case is over, but I am doubtful that he would do it. In my eyes, that really is the only hope we have right now. If the Judge stays the enforcement case pending the appeal, and if Cyberlux wins the appeal then there will be no receivership. However, if the Judge does not stay it, even if Cyberlux were to prevail in the appeal some 12-18 months down the line then the damage will be done. Cyberlux has been clear in court filings, they can't get government contract until they are out of receivership, if the Judge doesn't stay it and puts them back in receivership it will make for a dire situation.

Was out of town for a long weekend, and of course the order gets signed during that time. While it is good news that the initial receivership is terminated, there was very bad news as well. As I feared, and posted, the order contained a paragraph that lets all of us know the Judge is about to open another receivership on Cyberlux, this one for the 6 million (plus cost and fees) owed to Atlantic Wave. The Judge clearly does not see the receivers actions as excessive and above and beyond what he was allowed to do, instead the Judge seems to embrace it as a good job. I really do not know how Cyberlux survives this receivership. They have no money, and can't sign any contracts until out of receivership which looks damn near impossible at this point. It is clear to me that they didn't release any PR because despite having the receivership terminated, it can be said that we are in a far worse position now.

Still no order signed on the receivership case. There was a proposed order that was filed that could be very problematic if the Judge were to sign it. As I mentioned the other day, Atlantic Wave filed a new enforcement action in Harris County. The proposed order contains the following paragraph that pertains to that new filing:

If the Judge signs this, although the original receivership will be over a brand new one (this time for 6 million plus costs judgement) will be initiated on the heels of this last one. I would think that would sink the company as we would continue to not be able to get government contracts. If this happens, I would suspect a bankruptcy in which Datron would probably be sold off to pay all the debts. Lets all hope the Judge does not sign that order.

The final hearing on the receivership is set for 9:00 am (Texas) so hopefully this is all resolved today, although I would be shocked if this Judge signs any order within a few days of the hearing (he seems to take his time). Bit of a wrinkle in that Atlantic Wave has just filed a motion to enforce another foreign judgement against Cyberlux, this one for 6 million plus costs. This judgement was negotiated between Cyberlux and Atlantic Wave by the RECEIVER acting on behalf of Cyberlux, without their permission and above and beyond his authority because the underlying foreign judgement that this receivership is based on had already been tendered. My understanding was that Cyberlux was appealing that judgement, if it in fact is in appeal then the Judgement should be "stayed" and not fully enforceable at this time. Just another potential litigation nightmare scenario caused by this receiver. Stay tuned, we need the receivership to be terminated.
