Default judgement has now been entered against both DECN and Berman in the SEC case.
Berman's whining letter to the judge about the difficulty of obtaining counsel while incarcerated suggests that he may have been trying to kick teh can down the road further.
In order to have the default judgement vacated, Berman must meet both of the 2 following criteria:
(i) A valid excuse for his failure to respond.
Berman would no doubt argue that his incarceration made it difficult for him to obtain rulings and case documents and communicate with potential legal counsel.
Prima facie he may have a case here, but I am personally pretty skeptical. Berman has well established 'form' when it comes to paltering, obfuscating and stringing things out to delay or escape unpleasantness befalling him, and this looks straight out of that now well-thumbed play book.
(ii) A 'meritorious' defence.
I think 'Houston' may have a real problem here.
Berman has plead guilty to mirroring felonies in the criminal case, where the evidenciary bar was set far higher.
So I don't see how he can make this fly. As far as I can see (I could be wrong) a very very good and slippery lawyer would still struggle to make any case that a defence Berman could genuinely advance would be 'meritorious', and thus far Berman can't even seem to be able to procure the services of an 'acceptably bad' one!

I think this will move to the imposition of further penalties, which will be largely ceremonial, since he's broke and in jail.

Latest update on SEC case against DECN and Berman.
Despite filing for time multiple time extensions in order to secure counsel, both DECN as a company and Berman personally have now failed to respond to the unstayed action by the (extended) May 6th deadline. As a result of this, SEC have filed for default judgement to be entered against both.

If the default judgements are entered, then further (largely theoretical) sanctions could result.
For instance, Berman could be permanently formally disqualified from future directorships, and the amount of money that he owes (but can never pay back) could increase. Since he is already personally insolvent, that's probably pretty moot!

He would likely be unable to escape this type of debt through personal insolvency. It will stay with him and can be enforced until fully paid off, or - more likely - upon death. And when Berman finally shuffles of his mortal coil, his estate -if has has one - will be forfeit against his debt.

Permanent impoverishment is his lot!

SEC case is unstayed.
True to type, Berman has written to the Judge in the SEC case seeking a delay while he tries to get counsel.
He has been given until April 6th to get counsel and May 6th to respond.

He will have to go cap in hand. Civil cases don't qualify for legal aid, and if he has access to other funds, then those seeking restitution will no doubt be keen to revisit such a change in circumstances.
To me his only hope seems to me to find some sucker to represent him 'pro bono!'
But why anyone would do this is beyond me!

The YEARS of pure evil and crime that this lowlife has lived here are not wiped away by a year in a low security country club, teaching classes. Berman has until 21 Jan to respond in his personal capacity as defendant.
As regards to DECN as a corporate entity - default judgement looks pretty inevitable:
The incarcerated Berman doesn't have the funds to buy his own soft toilet tissue! (and is presumably being forced to use prison issue sandpaper ass-wipe at present!)
So I don't imagine that paying for corporate counsel for DECN to defend this SEC action is going to make it up into his Maslow 'needs hierarchy' pro tem.
And as a corporate, DECN cannot elect to defend the action 'pro-se' (i.e. self representation). So without legal representation a default judgement against DECN is almost a fait-accompli.
Berman could elect to defend himself 'pro-se' to get himself a day out in the fresh air.
But the criminal bar has been passed. The civil case against him is a slam dunk.
So I don't see there is much to be accomplished. He would just be turning up to wave, say sorry, and take his medicine.
And there is always the unappealing possibility of some of his victims turning up to wave back!

Reading this again, I see that the ruling was signed by Berman's original trial judge.
And I think Berman has actually irked him here somewhat. Maybe its my imagination, but I think this might be a bit of the 'bite' that has resulted from Berman's remorseless 'pulling of the tiger's tail' while the case was proceeding and he was still at large...
I actually expected this 'modification of payment terms' to go through on the nod, as Keith is clearly old, in ill health and basically indigent. Who would really begrudge an incarcerated white collar non violent criminal in those circumstances the means to afford his own anti-perspirant and toothpaste, priced at a considerable mark up, without being forced to sweat shop it out at slave wages in order to cover the extortionately marked up pricing being offered on a 'take it or leave it' basis?
Personally I wouldn't. (But I suspect Berman himself probably would have!...so)
And I think this ruling might be a case of "careful what you ask for".
This judge was well acquainted with Berman's pre-trial shenanigans and seems to have viewed this restitution appeal -for what I would see as access to basic human dignity - in the same light as those shenanigans.
While the beneficiaries of Berman's restitution may only be yielding peppercorn sums that will in no way compensate them for the actual financial losses they endured as a result of his profligacy with OPM, they can at least now console themselves with the thought that the privations and work that Berman - an old sick man - must endure in order to make those small payments far exceeds the effort that he expended while perpetrating his scams.
This really is rock bottom.
Berman's victims may have lost their pensions, but it seems that as a result Berman is basically reduced to begging, pleading and working hours, for buttons, just to be allowed the privelege of using soft toilet tissue. And the entirety of the legal system that he contorted and used to try and escape the consequences of his actions is now ranged against him in a Kafkaesque fashion to ensure that this will remain the case for the immediately foreseeable.

Berman has really dug himself into a hole here! He can't even rely on the charity of fellow men to haul him up!
Talk about hubris!!!!

The latest court filing tells us that Berman is HIV positive
Actually, It does not. There is absolutely no reason to suspect or suppose that Berman is HIV positive.
This decision merely cites the precedent of a previous case in which it was upheld that THAT defendent whose name was Vanhorn (and who was HIV positive) did not suffer a material change in economic circumstances by virtue of the HIV diagnosis since he/she not need to fund their own immediate treatment whilst remaining incarcerated. Vanhorn argued (unsuccessfully) that he/she now needed to save money to fund hisor her treatment upon release. But the court ruled that only represented a material change in his or her future economic circumstances, rather than his or her immediate economic circumstances, and this was therefore not sufficient reason for amending the terms of the restitution payments.

In Berman's case, the fact that the payments he was receiving from a charitable institution were not guaranteed in the future was similary deemed not relevent to his immediate economic circumstances, falling into the same trap as Vanhorn's future medical expenses, and so did not justify the reduction in restitution payment terms that Berman had sought.

He's actually quite lucky, I think. The fact that these charity payments may not have been known about at the time the restitution award payment schedule was set up means that a judge with less forbearance might have ruled that Berman's immediate economic circumstances had actually materially improved since the prior assessment, as a result of this charity funding and prison earnings. and consequently increased the speed of his restitution payments schedule.

The latest court filing tells us that Berman is HIV positive, and the government is paying for his treatment. This of course opens up the possibility that his live porn addiction may have involved him viewing male performers!!

its discretion by holding that the defendant’s HIV diagnosis did not work a material change in his

So what next if there is a default judgement against DECN and Berman?
If Berman engages it will be only to plead mitigation. Since the evidentiary bar on criminal cases is higher than civil cases, and the criminal case has been conceded, the SEC have a gimme here.
If DECN as a legal entity even still exists, I would expect it to be formally dissolved involuntarily for delinquency, not to mention insolvency.
As for Berman himself, well I would expect that this is a case where "the corporate veil would be pierced" due to his obvious serious misconduct, and the sins and liabilities of DECN would land on him personally.
As far as the litigation is concerned, the 'prayer for relief' reads as follows:

Enter an Order barring Berman from participating in an offering of penny stock,
including engaging in activities with a broker, dealer, or issuer for purposes of issuing, trading,
or inducing or attempting to induce the purchase or sale of any penny stock, pursuant to Section
21(d)(6) of the Exchange Act [15 U.S.C. § 78u(d)(6)].
V.
Retain jurisdiction of this action in accordance with the principles of equity and the
Federal Rules of Civil Procedure in order to implement and carry out the terms of all orders and
decrees that may be entered, or to entertain any suitable application or motion for additional
relief within the jurisdiction of this Court.
VI.
Grant such other and further relief as this Court may determine to be just, equitable, and
necessary.

What this means:
Clause I means very little in practice, unless he tries it again, in which case he could be held in contempt. It means "stop this fraud!"... but since he is now in jail, that has already happened!
Clause II probably means very little in practice, except to double down on Berman's indigence. There may be a dollar amount imposed as a badge of shame, but that won't ever be repaid.
Clause III could affect his livelihood subsequently as he would be banned from holding office in any incorporated company. No more C suite jobs for Keith.
Clause IV basically bars him from raising corporate finance for any of his ventures, which was how he had funded his lifestyle hitherto.
Clause V puts him under the scrutiny of the court, and prevents him from trying his luck in another state or jurisdiction
Clause VI means basically "Anything else you can think of to square up his victims!"

He will probably never be able to use a personal credit card, let alone form a limited company, ever again.

The letter hints at the likely outcome. There are 2 defendants in this case: Berman personally and DECN as a corporate entity. It seems untenable that the DECN corporate entity will be in a position to retain new counsel so a default judgement against DECN seems likely.

Berman could defend himself, but it is difficult to see to what end? A default judgement would be where I would place my bets there as well. Although who can tell.

A default judgement against both seems likely. Then whatever additional sanction the court can impose (which is likely to be de jure rather than de facto given the circumstances imo) will follow on.

Finally, SEC case has been unstayed....
This is because his appeal in the criminal case failed and he is now time barred from elevating the appeal.
In the mean time, one of Berman's original counsel has died, and the other has retired. So legal representation is an issue!

This was an aspiration, not an assumption.
I did not lose money on this DECN scam.
But I did seriously consider investing because - if its not already apparent and obvious - I consider I knew something about the underlying technology (Dunning Kruger notwithstanding!) and this WAS painted as an enticing opportunity.
The reason I did not invest and lose money is because OTHERS who had been taken in left information and experience that allowed me to see through this scam with a modicum of due diligence. I don't think I am any cleverer than Fuente. Just better informed in this case.

That's the link to the backend database that was hacked. That folder 'assets' and everything in it is not available on the customer facing side of the site. We know that because after someone alerted the company, access to this folder was removed.

If the ppt. actually showed up on the DECN site, it would look something like this:

The 'assets' subfolder is not there of course, because that is not meant to be public.

So we know that folder was accessed as early at March 30, by potentially someone other than the original poster.
