The fact is this judge is looking for any way to kick PRKR to the curb. He probably knew he would be overturned on appeal but assumed PRKR would simply go away. The big tech companies support politicians who view patent trolls like PRKR as harning innovation. Those politicians appoint judges with a similar opinion. That is why the judges look for any legal way to dismiss patent trolls infringement cases. The appeals court told the judge exactly what he needs to do to get rid of PRKR and implied they would not intervene. The appeals court said the Markman hearing must be held first before the case can be dismissed. The Markman hearing and subsequent ruling defines the patent and infringement. This judge will simply accept QCOMs claim construction where the terms of the patent are defined so as they do not infringe. I have seen this with other patent trolls. I even saw 1 judge give a favorable Markman ruling for a troll and the troll won then in another trials Markman ruling define the patent terms so there was no infringement. The troll lost that case. That judge ended up going to work for Facebook! lol. That is why I say with PRKR SELL the pops! IMO!

With potential damages in the billions it may be trading at call option value. Given that it has been sent back to the court there is now a higher probability of a settlement... which could be hundreds of millions / multiples of the current market cap.

There will be no trial until MAYBE 2025 then that takes YEARS. Even if you somehow win with a jury the judge would just throw out the verdict like your last attempt to sue QCOM back in 2014. Then comes the inevitable YEARS of appeals. Maybe even another US Patent Office reexam since they seem to grant most of them! That takes YEARS. The system is completely against "patent trolls" (non practicing entities). The politicians who get money from the big tech companies are appointing judges who share their opinion that patent trolls harm innovation and need to be sidelined. That is why the judge in the QCOM2 case tossed PRKR out of court. They recently won in appeals court and now the case will continue but that same judge will find another technicality to toss your case. I would sell the pop if I were you. PRKR has had a few pops over its life and you would have been wise to sell them.

Anyone have a timeline on next steps in the case since DC court of appeals sent it back for trial in Florida on September 6th?

I bought more PRKR in the past 2 wks. PRKR is in hibernation now but will come back to life in April or May when case is set for trial ). Last week another Texas Eastern District court found in favor of a small co. ( VLSI ) $2 billion verdict against Intel for patent infringement. Our cases could be HUGE.

I bought 10,750 shares at 54 cents each, not long before the Markman ruling, and am up almost $14k. It’s still way way undervalued. Looking forward to this ride.

PRKR ready to start to get ruling any day. Load up. Could double any day and really explode in May or April. Eastern District Court of Texas is called the ROCKET DOCKET. Filed one day and a ruling the next day. Billions coming in rulings. Look at the recent ruling out of ED. Apple had to pay over $1 billion + to another small company.

I think it was when ParkerVision hired Louis Freeh a former Director of the FBI, that I really took notice of how this could possibly play-out.

Do not be surprised to see a $billion.+ There are multiple lawsuits in the works. Look at the Apple lawsuit settlement of $2.5 billion w/ someone else on patent infringement. Parker is a genius w many patents.I think that 50 cents becomes $5. per share at the minimum. Qualcom has the $ and may settle out of court just to made it go away. However, PRKR is also suing many other companies using the stolen patent ( intellectual property ). The recent ruling was huge. The former FBI director Louis Freeh is the lead attorney.

How valuable do expect the settlements to be?

ParkerVision Receives Favorable Markman Order in Patent Infringement Action Against Qualcomm and HTC

JACKSONVILLE, FL / ACCESSWIRE / April 30, 2020 / ParkerVision, Inc. (OTCQB:PRKR) announced today that the United States District Court for the Middle District of Florida (Orlando division) issued its patent claim construction ruling, or Markman Order, in the ongoing patent infringement action between ParkerVision and Qualcomm, Inc. (QCOM) and HTC. The court adopted ParkerVision's position as to the proper interpretation of the majority of the key terms in dispute in the litigation.

The parties identified a total of ten disputed claim terms. The court's order adopted ParkerVision's proposed construction for seven of the disputed terms and adopted a slightly modified version of ParkerVision's proposed construction for the remaining three terms.

In a Markman Order, the presiding district court sets out the meaning of specific disputed terms that appear in the asserted patent claims. The court reviews written briefs and hears oral arguments from the patent holder and the alleged infringer each of whom makes recommendations to the court as to how the disputed terms should be defined. The court then issues a Markman Order, also known as the claim construction ruling, in which the court determines how each term is to be construed. The court's claim constructions are then applied in motions and at trial in the determinations of patent infringement and validity.

Jeffrey Parker, Chairman and Chief Executive Officer of ParkerVision stated, "We are pleased with the court's Markman Order, and we remain confident in our position concerning Qualcomm's infringement of the patent claims at issue in this case. This patent infringement action, filed in May 2014, alleges that certain Qualcomm and HTC product infringe numerous claims of four patents owned by ParkerVision. The parties originally filed claim construction briefs in June 2015 and presented arguments in a claim construction hearing in August 2015. Prior to the court's ruling, the case was stayed pending resolution of other actions. After the stay was lifted in 2019, additional briefs were filed by the parties and a second claim construction hearing was held in November 2019. The case is currently scheduled for trial commencing December 1, 2020.
