New Visual Provides Update on Extensive Patent Portfolio 779 Claims
Reveal the Scope and Value of NV's Technology SAN DIEGO, Feb. 3
/PRNewswire-FirstCall/ -- New Visual Corporation (OTC:NVEI)
(BULLETIN BOARD: NVEI) , an emerging provider of semiconductors to
the broadband telecommunications industry, provides an update today
on its extensive patent portfolio. Recently, the Company has filed
amendments to its patents, and has received notification that its
patent applications are progressing in several countries. New
Visual has developed or licensed 11 patents. There are currently
779 unique claims in the patents, and other patents have referred
to these patents 71 times, indicating the broad scope of the
Company's intellectual property. They form the basis of Embarq(TM),
the groundbreaking semiconductor for the broadband industry. Dr.
Walter Chen, a member of New Visual's Technical Advisory Board,
stated, "The patents, some of which are co-owned by New Visual and
Adaptive Networks and some of which are licensed from Adaptive, are
impressive and valuable. The Company has positioned itself to
benefit from the growing, international broadband market. The
demand for faster and better Internet connections continues to
rise, and the technology offered in the Embarq(TM) suite of
products will enable data to be transmitted faster than any current
technology." Additional information on New Visual's intellectual
property can be found at http://www.newvisual.com/. The contract
that underlies the licensing and joint ownership of the patents was
entered into on November 26, 2004. It is an amended development and
licensing agreement with Adaptive, experts in powerline
communications. Under the Amended Agreement, Adaptive has provided
New Visual with final delivery of the source code, intellectual
property rights and other materials that make up Embarq(TM) and
additionally has waived its right to receive the first five million
dollars in royalty payments that it would otherwise be entitled to
in consideration for New Visual's waiver of its potential right to
receive payments based on future Adaptive profits and other
consideration. With the original agreement dated April 17, 2002,
New Visual acquired a worldwide, perpetual license to Adaptive's
PowerStream(TM) technology in the field of the copper telephone
wire telecommunications network. The Agreement also called for New
Visual to contribute to the definition and costs, and jointly
co-own significant enhancements to this technology. Together,
PowerStream(TM) and its enhancements provide the core technology
for New Visual's semiconductor technologies, known as the
Embarq(TM) family of transport processors. Embarq(TM) allows
telephone companies to transmit data at speeds of up to 100 Mbps
across a single pair of copper wires. Dr. Michael Propp, Founder
and President of Adaptive stated, "Adaptive has invested more than
twenty million dollars toward the development of this fundamental
and powerful technology. We are pleased to benefit from New
Visual's expert management team to commercialize it for the global
DSL marketplace and are happy to facilitate their entry into this
market with this amended agreement." About New Visual Corporation
